Can you get arrested for driving without a driver's licence, or will they just fine you?

They will most certainly arrest you if you are alone - they won't let you carry on driving! And if you cause an accident, you will also be arrested (as will the owner of the car as your possession of the car translates into carelessness on the owner's part). If you are sitting in the drivers seat, and the keys are in the ignition, you can also be ticketed if you do not have a license.

well I made an accident a few years ago without a licence, something im not proud of at all, and it comes on your criminal record. But I wasnt arrested. I advise not doing this. 50% of south africans dont have valid licenses though

My mother in law was caught driving without her licence a couple of months ago and the Metro Cop refused to let her drive any further. She was forced to phone my brother in law to please go home and pick up her licence and bring it to her. She still got a fine on top of that though.

they will not arrest you because they can check if you have one on your ID number but they can fine you

They fine the car owner (same as with speeding fine). If you go to a police office within 24 hours and present your license the fine gets drastically reduced. At least thats the way its SUPPOSED to happen, this is SA after all and they just do what they want.

Do they actually check or is it just in Port Elizabeth where I believe very few taxi drivers have a licence. I would never suggest to any one drive with out a licence.

A couple of months ago I was driving to our local Spar to get bread so I didn't bother to check that I had my license. And then I could've taken another turn when I saw the blue lights but I thought that it was an accident and figured I'd rather drive past in case it's someone I know. Well it wasn't an accident but a road block in the most unexpected place. So I got pulled off and first thing he asked was can I see your driver's license please. So I said but I live just down the road and I was just getting bread and didn't think of but before I could even finish he was already writing up the fine... R500!!!!! No fortunately I wasn't arrested and I did manage to get the fine reduced to R250 but yeah rather always have your license with you than give this government any more money than we need to !

Yes they can arrest you - a friend of mine (many years ago) borrowed his dads porche (jaaaa) and had an accident. They suspended him from getting a license for 7 years.....that was back in the good old days when you had to listen to the cops. That was huge problem in his life.

You can get arrested driving with a licence too , you know? But don't take it as a cause for concerb, sorry, the b is next to n on my keyboard...concern, it's cheaper to bribe than let them fine you, but alas, I've still refused to pay a bribe. I feel SO alone!

As far a I know you SHOULD only get a fine, which also should be less if you later prove you do have a valid one. But there is much incompetency and corruption amongst the traffic officers. So never do it. I have mine attached to my keys in one of the the plastic gadgets the street vendors sell. Yet it is easy to forget if you take a work pool car etc.

In Durban on the Southern Freeway and on Esplanate rd they often got roadblocks to check your licence,even late at night.They also got a court in a mobile home right there.You definitly just get a fine so rather not take chances.Check out the N1 between Colesburg and Richmond too.Not nice to get stuck in the middle of nowhere.

Just a fine. If my purse get stolen with my license in it and I drive to the police station to report the theft - and then get arrested for not having a license? - I will take the state to court and claim the Union Building for compensation. I will then move in there and invite all of you to the house warming.

If you are a minor, in the RSA, under 16, the Police will take you to the nearest Police Station and phone your Mom and / or Dad, although they can fine you as well. If you are a citizen, over 16, you need, for a motor cycle, at least a learners' license, for any vehicle, a learners' accompanied by a person with a VALID drivers' license. If not the case, you can be arrested, yes. You can be released when you indicate your Legal representative (State or private) with on bail - for a fine. You still will have to appear in Court.
